While cannabis is legal in Canada, importing cannabis seeds across the border is illegal under the Cannabis Act. Canada Border Services Agency treats all international cannabis imports as criminal offences regardless of domestic legalization. Seeds must be purchased from licensed Canadian producers. Enforcement in Canada carries fines from CAD 1,000 to CAD 500,000 and imprisonment up to 5 years in aggravated cases under Customs Act s.159, s.160; Controlled Drugs and Substances Act.

Leaving Canada with cannabis seeds
Cannabis seeds fall into an ambiguous cross-border category — many jurisdictions treat viable cannabis seeds as controlled cannabis material under the Controlled Drugs and Substances Act; Precursor Control Regulations framework. Even where domestic hemp cultivation is legal, cross-border seed export typically requires an origin-country export permit and — in the destination — a corresponding import permit. CBD-strain seeds may face slightly lighter treatment in some destinations but the specific rule varies. Sterilised (non-viable) seed products (for bird food) may face lighter treatment. Verify both origin and destination rules independently.
