While cannabis is legal in Canada, importing cannabis seeds across the border is illegal under the Cannabis Act. Canada Border Services Agency treats all international cannabis imports as criminal offences regardless of domestic legalization. Seeds must be purchased from licensed Canadian producers. Enforcement in Canada carries fines from CAD 1,000 to CAD 500,000 and imprisonment up to 5 years in aggravated cases under Customs Act s.159, s.160; Controlled Drugs and Substances Act.

Surrender at customs

CBSA accepts voluntary abandonment of cannabis seeds at port of entry. Declare at primary inspection. Form E-15 not required for voluntary surrender. Seeds are destroyed — no criminal proceedings for personal quantities proactively disclosed.

Cannabis seed export from Canada is generally prohibited or heavily restricted regardless of domestic hemp / cannabis legal status.

Practical advice

Do not bring cannabis seeds into Canada. Purchase from licensed domestic retailers. If unsure, declare on arrival — declared goods at worst attract duty or surrender, while undeclared goods found in screening are seized and fined.
